Washington D.C. Bans Unofficial Public Gatherings

(2008-02-05) — The District of Columbia this week banned all public gatherings not organized, funded and run by the government. In prohibiting all privately-organized rallies, protests, church and club meetings, the District used the same reasoning that moved it to ban private handgun ownership.

The Supreme Court on March 18 will hear a case (District of Columbia v. Heller) challenging the D.C. handgun ban, which was struck down as unconstitutional by the U.S. Court of Appeals for the District of Columbia Circuit. Lawyers for the District will claim that “the right of the people to keep and bear arms” is restricted to government-sanctioned people, like those in the National Guard, because of the amendment’s preamble, “A well regulated Militia, being necessary to the security of a free State…

“Just as the Second Amendment applies only to government agents,” said an unnamed District spokesman, “so it should be logically inferred that the ‘peaceable assembly’ clause in the First Amendment applies only to government-sanctioned gatherings. Why would the Constitution ban private handgun ownership without also clamping down on potentially-incendiary public meetings? Both are clear and present dangers to the government.”

The move comes as part of an ongoing process by Washington D.C. officials to institute “a fresh understanding of the U.S. Constitution not constrained by individualistic interpretations.”

“When you hear the phrase ‘We the people…’,” the official said, “you need to realize that it means a select group of people who have the power and right to dispense liberty in reasonable doses for the good of all those other people. If the founders who wrote the Bill of Rights meant something else, it’s incumbent upon us to correct their misunderstanding.”

The District will hold an official public rally next Thursday to celebrate the new ban.

    The term militia is commonly used today to refer to a military force composed of ordinary citizens to provide defense, emergency law enforcement, or paramilitary service, in times of emergency; without being paid a regular salary or committed to a fixed term of service.

    Scott, that sounds so perfectly Governmental it causes me to wonder which particular politician you are quoting? I can only guess, sadly enough I can’t even guess which side of the aisle it might be.

    I do know that without the Second Amendment, 100% of the rest of the Constitution is nothing more than a bunch of gobbledegook and chicken scratches on a piece of paper that otherwise wouldn’t even make good toilet tissue.

    I own a .40 caliber Browning handgun; a large heavy weapon that will pistol-whip a problem before I ever have to pull the trigger. I bought both my daughters Sig Sauer P-232 9mm pistols when they turned 18.

    Hawk - Re 2. I’d avoid the ‘current common definition’ trap when discussing the meaning of a 219 year old document. After all, having won independence from the British crown, our countrymen were admittedly openly gay and proud (if you get my meanin’).

    Regardless of what the definition of the word ‘militia’ was, whether it be in the hands of the government, private citizens, or somewhere in between, who do you suppose has the job of keeping the militia “well regulated”?

    Hint: Those guys writing the Bill of Rights had just experienced a “small ordeal”, having just taken up arms against their own government to forcefully take what was rightfully theirs and then leave to us to have and protect with the same reverence and vigor.

    Or not.

    We can sit on the couch, glued to the 52 inch plasma while our elected representatives piss it all away. Whatever.

    It’s amazing to me, how many years of my life was spent thinking that the Constitution “gave” me the right to own and bear arms.

    Finally, 8 years ago, at the age of 62, I took a closer look at the Second Amendment. I was surprised to find that it didn’t “give” me anything. Rather it acknowledged the right of the people to own and bear arms, and further prohibited strings being attached to that right.

    From what I recall in history, at that time, every able bodied male was considered to be a fundamental part of the Militia.

    Fred, it also allows for (as Scott points out) peaceful assembly but that right was denied many at the last round of national conventions. They were herded into fenced off lots blocks from any of the action.
    That was hardly “freedom”

    bya #20 You’re right. Unfortunate as it is, sheep deserve to be penned. The schoolyard bully “gets away with it” once, the next time will be worse. (ALWAYS - NO EXCEPTIONS)

    It will require some busted heads! In the Mid-east and part of Europe, the “Brown Shirts” are met with broken bottles and brick-bats, facing rubber bullets, tear gas and water cannons. (They refuse to be herded like sheep)

    The basis of our Second Amendment - Those who have all the guns will rule those who don’t.

    Well what’s the problem with that, Scott? The government is only taking its cues from liberal fascists who have long maintained that phrase “the right of the people” in the Second Amendment isn’t an individual right like the other Amendments which refer to “the right of the people.”

    And just when did “militia” get twisted to mean “select militia” or “state militia”? And the statements “the right of the people to keep and bear arms” is a direct reference to the reality that the right of individual protection predates the Constitution and the Bill of Rights which were simply enumerating the pre-existing right to keep and bear arms and not making it up out of thin air.

    Liberals are such stupid, ignorant twits! They’re the same people who read that in the Constitution’s preamble where government has the duty to “promote the general welfare” and read it as government should “provide welfare.” I guess the average lib thinks because the two words start with “p” then they must mean the same thing. Well, I wonder what they think of the association between “Democrat” and “Dunce”?

    Lately I’ve been contemplating the rise of liberal fascism in our nation the last thirty or forty years culiminating in sHrillary and Obama running for President and I ran across this following account:

    A Bolshevik revolutionary was standing on a soap box speaking to a small crowd in Times Square. After describing the glories of Socialism and Communism, he said: “Come the revolution and everyone will eat peaches and cream.”

    A little old man at the back of the crowd yelled out: “I don’t like peaches and cream.”

    The Bolshevik hesitated and then replied: “Come the revolution, Comrade, you will like peaches and cream.”

    Just substitute “progressive” or “liberal” for Bolschevik and that’s what we’re looking at with a Democratic Congress and President.

    bober, large crowds of liberal activists always present a security problem. There rarely is a “peace” rally without some kind of property being destroyed, or the area being littered, or other people being threatened by “peacenik” goons.

    BTW That collusion between McCain and Huckabee in the WV caucus demonstrates that they are like the Bill and Hill Show in needing two to take on one. I guess that McCain is showing Huckabee how to be a Washington insider and how to cut back room deals. A pox on both of them.

    At virtually every point, the Constitution as originally signed existed specifically to LIMIT the power of government. The Rights of the People were *assumed* (and then, in the Bill of Rights, confirmed).

    Most of the Amendments after that would have been unnecessary (in fact, even the first ten would have been extraneous) had that view of the role of Government continued; sadly, as the Founders themselves knew, even a small concentration of Power among a small group of legislators, judges and executives eventually corrupts them; it didn’t take long for that to happen.

    It’s likely the District can work out a volume deal on getting signs printed, and presumably work something out with a few Hollywood writers so the crowd (and the antiphonic choir of “hecklers”) have decent scripts from which to work.

    Romney’s paying 25 to 50 times as much per delegate as the guy who won in WV. Mitt’s neatly packaged and very, um, slick, but in a democracy that’s not always enough. Not even with advertising.

    I have to say, though, that Romney’s arrogance and bitterness raise serious questions about his fitness for office. I hope he lightens up soon; the attitude that Republicans simply owe him the Nomination is offensively presumptive and could hurt him at the Convention. He’d do well to adopt some of Ron Paul’s or Mike Huckabee’s grace.

    As I read Scott’s excellent piece I kept thinking that I was listening to aShrillary speech or somethin’ from a lunatic lefty. I hope he didn’t give any of the current candidates any idears.

    Anyhow, I don’t see no way Bush could’ve sold the White House to big oil seing as the Slick Hick done gave it to his Chinese buddies.

    I hear that McShame only took his home state orf AriZoner by 5 or 6 points, maybe some folks were successful at weakening him a bit ? Time will tell for sure.

    I heard a bit of Romney’s boy on Hannity today and one thing that struck me was how he was blasting Shuckabye for having a sudden change of mind on border security, and while that is seemingly accurate enough, I heard him using all of the phrases that Hannity has been saying, just the same way Sean has been saying them for a long time and I thought to myself, you are saying it, but you are just parroting his words on his show to get support from his audience. Does he really mean it, or is he just saying what he knows will play in the land of the Hannitized ? I also thought, yeah, you guys blast someone else for changing their position, but what about the abortion issue ? To me it was a bit disingenuous and a little opportunistic, but I guess that is the way you play the game.

    I thought about what I would try to do if I were seeking elected office a while back and I came up with my strategy, I would never say “if I am elected”, neither would I waste my time telling you about my opponent. I would have a list of objectives that I would make my priority upon being elected and that is what I would discuss 95 to 100 percent of the time and I would tell the voters that if they agreed with my ideas then they should vote FOR me, but if not, that I would just as soon that they did not vote for me.
    Knowing where they stand on current issues is good, but I really want to know what their vision is, that gives more insight into how they think.

    Do any of the current candidates have a vision for America ? Some have an agenda, but I don’t know if they are very farsighted, just a bunch of shortsighted vote barterers, or fanigglers.

    That annoying troll makes a bid deal about the size of the budget, but just try cutting anything out and listen to his elected heroes cry about the draconian cuts, his pals want to spend as much or more, just differently, no Iraq war, free health care, free drugs, cradle to grave no worries. Ain’t nothin’ free in life, there is always a cost. there are costs for actions and costs for inaction, tax and give them freebies…..where are the great citizens who were too proud to take a handout, even when they needed one? If I don’t earn it, I don’t deserve it or want it. That is one thing that makes a great people, not all of this so-called caring and giving. And yes, I do give, but I do not ask or want anything in return.

    Fred Re#39: That’s why I said “outlet.” I’m a very regular Hannity listener, and was thrilled to meet him when he spoke in my area, but when I heard his response re Clear Channel I thought it was a bit of a tap dance.

    Sean’s under contract to Clear Channel (Bain &co.) in 80 of North America’s largest radio markets; though he’s on many other stations it’s likely CC brings him half or more of his listeners. I don’t have a problem with that — in fact, it’s commendable — but it’s a much closer relationship than Sean implied on his show.

    But, instead of Gov. Romney spending his millions on a conventional campaign, maybe he should take his checkbook directly to the floor of the Republican Convention.

    Just checked with FOX and it seems Huckabee has made, all by himself, the gift of McCain as the RNC entrant this November.

    The MSM is predictably reporting Romney to be superfluous and therefore he should have the decency to bow out of the race.To me this is their acknowledgement that they are scared silly of him being the RNC nominee.

    They are pulling out all the stops to help McCain be the nominee, convinced that Mrs. Bill Clinton - (aka HillBilly, Inc.) can easily beat him, and in the unlikely event that he should win, at least he’s so indistinguishable from her that they could at least live with him as President.

    Fred, if ALL of Huckabee’s delegates went to Romney, Mitt would still be miles behind. Blaming Huckabee for Romney’s problems ignores the simple fact that the voters just don’t want him.

    But there’s another inconsistency: if Huckabee is the opposite of Romney, why would presumed Romney voters be defecting to him?

In your opinion, Pat Buchanan is a “whacko” because he believes that McCain will continue to sell out the Republican party. Since McCain’s obvious left-leaning liberal policies are acceptable to you, then vote for him. McCain-Feingold violating free speech, McCain-Kennedy violating national security and sovereignty, McCain-Lieberman promoting the “man-made global warming” myth…none of these positions are acceptable to me.

    1. He might bet enough votes that the election is decided in the courts (again) or in The House of Representatives. Then conservatives would be able to object to almost anything on the basis that it was the action of an “unelected” government. I know, old, but it does work.

    2. The 2012 campaign for a Conservative Party Candidate might be financed through the sale of “Don’t blame me: I voted for Ronnie” bumper strips. Nice touch, too, that the “Ronnie” could mean a variety of things. Only the “heart” of the person applying said bumper strip knows the truth!

    How about putting our faith back in God and let politicians do what politicians do? I know that we want a good right leaning God fearing candidate to get behind, but folks, we aren’t going to have one, at least not for this time. Maybe this is God’s perfect will for America now? I suspect that there are hard times ahead, maybe bad enough that men’s hearts will fail them…..I think I read that somewhere or another…….what book was that in ? Help me out here……

    mkk Re#59: Putting our faith in God means acting on that faith, not just waiting to see what He’s gonna do. The Founders were believers who acted on their faith. We must do the same.

    gafisher - True, but I know that we are prone to assume God is in favor of this or that and so we go about doing what we assume to be his business and son are working in our own flesh and power.
    All I know is that nothing would have had any more influence and power than thousands, or millions of believers on their knees crying out to God for our nation.
